چکیده

We present an empirical analysis of the effects of patent thickets at the European Patent Office on entry into patenting by UK firms. Using a direct measure of patent thicket density, we provide evidence for the existence and growth of patent thickets in specific industries, notably in telecommunications, audiovisual technology, and computer technology. Our analysis indicates that the density of patent thickets is associated with reduced entry into patenting in the particular technology area (controlling for the level of patenting in that area). We find this effect to be particularly pronounced for electronics and telecommunications. It is also stronger for smaller than for large companies. We are grateful to the Intellectual Property Office of the United Kingdom for research support and to the National Institute of Economic and Social Research for hospitality while this paper was being written. The views expressed here are those of the authors. They are not necessarily those of the UK Intellectual Property Office or NIESR. The revision of this paper has benefitted from comments by participants in seminars at the UKIPO, the USPTO, and the University of California at Berkeley. *Corresponding author: [email protected] 08 Fall

Patents, Thickets and the Financing of Early-Stage Firms: Evidence from the Software Industry

The impact of stronger intellectual property rights in the software industry is controversial. One means by which patents can affect technical change, industry dynamics, and ultimately welfare, is through their role in stimulating or stifling entry by new ventures. Patents can block entry, or raise entrants’ costs in variety of ways, while at the same time they may stimulate entry by improving ...

The coincidence of patent thickets—A comparative analysis

The growth of patent thickets—technology fields that are characterized by a large overlap of rights between different right holders—poses a challenge for innovators. Patent thickets are argued to create strong friction in innovation due to a pronounced potential for holdup. So far, we do not know whether patent thickets coincide in all patent systems or if differences exist that policy makers a...

The problem of patent thickets in convergent technologies.

Patent thickets are unintentionally dense webs of overlapping intellectual property rights owned by different companies that can retard progress. This article begins with a review of existing research on patent thickets, focusing in particular on the problem of patent thickets in nanotechnology, or nanothickets. After presenting visual evidence of the presence of nanothickets using a network an...

Patent Thickets and the Market for Innovation: Evidence from Settlement of Patent Disputes

We study how fragmentation of patent rights (‘patent thickets’) and the formation of the Court of Appeal for the Federal Circuit (CAFC) affected the duration of patent disputes, and thus the speed of technology diffusion through licensing. We develop a model of patent litigation which predicts faster settlement agreements when patent rights are fragmented and when there is less uncertainty abou...

Conflict Resolution, Public Goods, and Patent Thickets

Post-grant validity challenges at patent offices rely on the private initiative of third parties to correct mistakes made by patent offices. We hypothesize that incentives to bring post-grant validity challenges are reduced when many firms benefit from revocation of a patent and when firms are caught up in patent thickets. Using data on opposition against patents at the European Patent Office w...
